Records
The Records Unit is responsible for the maintenance and dissemination of all records created or collected by the Sheriff’s Office during the course of criminal and non-criminal investigations. This data may be classified as public, private, confidential, or protected nonpublic (MN Statute 13.02).
You may be asked to provide identification in order to receive data classified as private.
Records Request
Request for records may be made via email, Todd.records@co.todd.mn.us, Fax 320-732-3754, by Mail, or in Person.
Investigative data collected or created by a law enforcement agency in order to prepare a case against a person, whether known or unknown, for the commission of a crime or other offense for which the agency has primary investigative responsibility are confidential or protected nonpublic while the investigation is active.
Law Enforcement Data are Governed by MN Statute 13.82.
Accident / Crash Report
Request for Accident Reports must be in writing and may be sent to the Sheriff’s Office via email, Todd.records@co.todd.mn.us, Faxed to 320-732-3754, via US Mail, or in person.
MN Crash Reports are Private Data on Individuals and are governed by MN Statute 169.09.
Body Worn Camera Footage
Body Worn Camera footage is Private Data on individuals and is governed by MN Statute 13.82 while a case is active and by MN Statute 13.825 when a case is inactive.
The recommended interpretation of MN Stat. 13.825 regarding Body Worn Camera footage from the Data Practices Office of the MN Department of Administration is such:
Our guidance is that 13.825 classifies "data," - individual pieces of information - and the data subject is only entitled to those pieces where they can be seen or heard. If there are portions where they are neither seen nor heard, access is not available to them.
Fee
There is a fee of $0.25 per page for copies of all reports.
